P90X/Ebay/Legal issues!!!

I agree with the above posters. Discussing another company's business practices and explaining yourself when what you do is being attacked universally is NOT what Chris was talking about in that statement. At the time he wrote that, the problem was with people constantly marketing themselves as coaches and trying to use the forum to sell the product as well as having links to BB in their signature lines etc... Joan never does this and is only giving her viewpoint because she happens to know a little about the subject being described. To say that none of us can defend or discuss other products is ridiculous and not what Chris was talking about.
 
I'm sure Joanna and Mspina are both lovely people. If I were to buy a BB product again, I'd like a coach like them. The problem is they are not posting to this thread as consumers. If they post to support coaching, it does indirectly benefit them because people trust them and believe what they say. It's different if Liann (Not picking on you, darling) posts to say good things about BB and coaching. AFAIK she doesn't benefit from consumers supporting the coaching model. BB coaches do. I have nothing personal against either lady. When they post about BB, it goes against the spirit of the forum which is consumer driven opinions.
 
It's definitely a fine line. And it did get out of hand a while back there (not because of Joan though). I'm glad that Chris posted what he did when he did. No one likes getting a sales pitch from other forum members. My wallet is in enough pain just from Cathe gear! I personally will NEVER buy from BB directly. I only buy from a web site that is run by a BB coach, but there is never any pressure from her to buy stuff. I know that she'll take care of any customer service needs I have where as BB has an AWFUL track record for how they handle their direct customers. And I also agree that there is probably better terminology than "coach" for the sellers. Unless of course they are referring to you being coached into making a purchase. ;)

They're both posting to provide some insight to the OP on her issue (and for anyone else who has a BB product they'd like to get rid of on eBay). Neither are doing anything remotely close to what Chris was trying to address.

I have to chime in for Joan. No, I never saw any thread post by her trying to make the sell. Like, Gayle, I really appreciated her insight of BB products. I always came to her about BB products. She gave me very straight forward answers based on her own experience. The fact is every time I found some new BB products, I found out in this forum. Then I reached out to her. I told her what kind of products I was looking for. Truth is, I actually did not order one DVDs series based on her feed back. She also provided me impeccable customer service since I am kind of computer un savvy person. I screwed up my orders sometimes. But she went miles to help me to sort out.

I did not think she violated any rules of this forum. BB and their hired lawyers might went too overboard fighting pirate copies. I don't like what they did. I will never buy directly from BB. The incident will make me sure one thing, I will talk to my coach Joan before I place any order.

I've had my ebay account suspended last night, after selling legit boxsets of P90x. I must admit, that i'm kinda worried about having emails, or letters threatening me with legal action as I didn't knowingly do anything wrong. The few boxsets I have are not fake and I just would not sell anything counterfeit whatsoever! I don't know if Beachbody can touch me over here in the UK, either way, I've never ever been in trouble for anything during my 33 years. Since I have found out that apparently what I'm doing is wrong, I won't be doing that again! It's wasn't my intention to infringe anyone's copyright or do anything illegal. However, this lesson has been well and truly learned!

I'm sorry this is happening to you. Strange you can't sell your personal set of P90X!

I ordered Chalean Extreme from Ebay about a year ago and needed the thigh toning band so I called Beachbody and when they asked what my order # was and I told them I got it from Ebay they told me they wouldn't sell any of their products to me. I asked them, "you don't want me as a future customer?" and they changed their tune and helped me. I've heard one too many negatives about Beachbody :-( As much as I loved CE & as great as some of their other programs are, I don't know if I'll buy from them in the future.

You didn't do anything wrong, you have every right to sell your property. They did the same thing to me. I emailed whoever they told me to email, sorry it was a while ago, and I don't remember exactly who, but I told them I was selling my used copy and they said, okay. My ebay account wasn't suspended, but it some kind of mark against it because of beachbody, but they removed it and everything was fine.

I will never buy from beach body again. It is all a scam to keep people from selling used copies of their products, so they can sell more new ones, IMO, but I think all they've done is make a bunch of people swear not to buy their products again.
 
A few months ago this happened to me, too. The company that eBay said to contact never replied to me. So, the last message I sent to them had a couple of cuss words (none of the major ones). About an hour after I sent the last one, I got a call from an attorney that works for Beach Body. I didn't answer, didn't call him back. Then I got an email from him. I didn't reply to that either. I do, however, work for a large international law firm that specializes in Intellectual Property. I talked to a Partner in the IP department, and he said "Nothing to worry about".
 
I just received a letter from Johnson & Pham. Ireceived it June Friday 10th, 2011. Giving me only 7 days to pay $15000.00 I only sold about 9 units of Brazilian BUtt Lifts. Can you please let me know what you out come was with them? I am worried about this situation and need help of what to do. Thank you so much for your advice.

If they were your own copies that were purchased via a BeachBody coach or from BeachBody directly, you have nothing to worry about. If they were bootlegs, I'd contact your lawyer, as you did commit a crime and they could legitimately go after you in court. Crime never pays!
 
This is an interesting topic, as I'm a BeachBody Coach. Piracy is a crime, so I can see where there would be some concern from BeachBody. I get very.... I'm not sure if "disgusted" is the right adjective, but it definitely bothers me when I see people pirating music, movies and all this stuff that people have put so much work into producing for their livelihood. Think about it - it's a business that employs a lot of people. Then someone comes along and makes copies of it and sells it. They did nothing to earn the money they are making. That's why I don't buy music from anyplace except where I know the artists and record companies will get a share of the profit. I look at the big picture.

But to your point, this is scary. And I'm sure Nicole is right. If you did buy them legitimately from BeachBody, then I don't believe you have anything to worry about. They've already made their profit from your purchase. It's like you selling a used car. Perfectly legal. I'm sure they're doing a "blanket" cease and desist because this is becoming a problem. Put it in the perspective that you are the person who put so much effort into creating something that will support your family and the families of the people who helped you produce it. Wouldn't you try to stop people from selling fakes?

Let us know how this works out. I hope you don't stress too much.
 
this sorta remindes me of recently having my computer taken over by someone. i lost everything and got tons of error messages. a box did come up that said it would fix windows vista.so,i clicked it and at the end it asks for money-which i did not do.is this law firm ligit? i was going to check it out but do not want the same thing to happen. the law firm could be a scam. maybe once BB got picked on elsewhere and continued to get picked on because the more thats done the more people believe it.
