Lawyers: Is "anger" considered a disability?

I don't want to go into too much detail, but someone at work has blown up several times, yelling, etc, and it's making life there miserable. I am not kidding when I say I am afraid of him. But with all the litigation nowadays, I'm wondering if he would he be able to claim that treatment for anger managment means that he is disabled, and can't be punished for it. I don't want to wait for him to do physical harm to me or someone else before this is dealt with. Thanks.

I'm no lawyer, but I would think that you have a much better case in that this person is creating a seriously hostile work environment.

If you genuinely feel AFRAID of him I think YOU have a case. How horrible for you. Where I work, pretty much everyone's nuts and you kind of develop a strategy (i.e., you make sure you're nowhere near them) to deal with the nuts. But I work in a large facility and can actually do that.

Anger itself is not a disability. However, it may be a symptom of some mental impairment that is a disability. ADA considers a disability 1) a mental or physical impairment that 2) substanitally affects one or more major life activities and 3) is permanent.

If he is threatening people and they are legitimately in fear, the employer is setting itself up for a lawsuit if he does, in fact, assault someone. They have notice that the has violent tendancies. Go to HR and make a complaint. Tell them how you feel and your concerns.
