My story is long so I'll just cut to the chase 5 years ago I broke up with this guy who asked me to marry him and I said no tried to return the ring a few times he didnt want it said to keep it. (Keep in mind this was in 2004)when I broke up with him I took nothing but the clothes on my back and my child (not his)we had a house. Moved on with my life fast forward to now Im married have a baby moved out of town. Come to find out this guy has been trying to sue me to get his ring back since we broke up.The way I found out was I received a letter from my town stating they were going to start garnishing my paycheck for the money of the ring Apparently he had been trying to serve me with no response. I had to hire a lawyer for this crap ($3500)now the case keeps getting posponed WTH ????
 
Wowzer, did you just try to give the ring back? Has this gone to court yet where you could tell the judge he didn't want the ring back?
 
I tried to give it back but he didnt want it. No it has not gotten to that point but I think it will my lawyer has gone to court twice and the judge keeps posponing it because of the his lawyer.

Wonderwoman- one's wages usually cannot be garnished unless and until there is already a judgment against you, meaning whatever case he filed (replevin, conversion?) has already worked its way through the courts and they ruled in his favor. Has your attorney succeeded in getting the case reopened for you because if service problems? When you say the judge keeps postponing it because of his lawyer, what do you mean? Has his atty asked for and received continuances? What kind of hearing were you set for that gets continued?

Yes my lawyer did get the case reopened he was able to get an order to show cause My not responding was why they ruled in his favor. But I was never served properly and I was able to show that. His lawyer is terminally ill Im assuming thats why it keeps getting postponed.
 
Sounds like he got a default judgment against you; in some states you can garnish if you haven't paid the judgment but he needed to show why he should be able to.

If you're right and it's the other attorney who is ill, that would be a great reason to postpone it. Keep in mind that attorneys' schedules can also be a reason to postpone, as well as the judge's schedule. It's summer and that can make it difficult.

Ok here is another question. Where is the ring now? Do you still have it, and if so do you want it, or are you willing to give it back? Was he asking for the actual ring or the $ value of the ring? I always urge my clients to cut to the chase. 97% of cases get settled without trial. With that number, it would make so much more sense to sit down like kindergarteners (who are VERY good a t dispute resolution as opposed to adults) and resolve the issue instead of wasting money, time, and energy which always happens in litigation. Not to mention the exasperating emotional turmoil. Can this matter be resolved and wrapped up? (Hmmm, guess that was way more than aone question huh?)

Hi Karen. Yep, I'm in Bainbridge (hence the Kenston school district) and I'm an attorney on hiatus to raise my monsters. How come I've not "met" you already on these boards? And more importantly, how come you're not roadtripping with us in 2 weeks? Are you in Chagrin or Bainbridge/Auburn? Do you practice locally? We'll have to set up a time to meet one another. Hey, whatd'ya' know -- a fellow Catheite right here! Cool.

I only found this forum a few months ago so I am still getting to know people, etc. I also was late to the Road Trip and it was sold out by the time I read about it-- it looks like a lot of fun (although I am *so* not a step person so I would run straight to the back of the room for step workouts!!). I live in Chagrin and I have been practicing for 15 years (most of the years with Calfee, Halter & Griswold) and I teach at CWRU Law School but I am part time now because I have a 1st grader and want to spend time with her (so I only work 3 days a week).

I actually think I may have seen you around town sometime- you look so familiar! Do you by any chance go to classes (yoga, etc.) at the Fairmount Center? I'd love to meet up sometime.

Ohhhhhh Noooooo. My DH will die to hear this -- so does he. Actually, he just went from adjunct to full time status. He teaches death penalty and all the crim stuff, as well as coaching mock trial. PM me with "who you are" -- he'll go nuts to think there's another Catheite at the law school. Small world huh? Too funny.

No, never at Fairmount Center -- but what about the rec center (CVRC)? I'm actually teaching a Sparklettes class there this Friday.

ok- this is wayyyyy too much of a conincidence, because my daughter is in that class this Friday!! So I guess I will meet you sooner than I thought!! My name is Karen Visocan (I am sure most people could figure out my name through Google with all the info I have already given out, so I don't mind sharing) and I teach in the CaseArc program (2nd years).

About your situation, sorry about the endless continuances! Can you just give him the ring back and leave it at that? I hope something works out soon.
 
Tell me about it and good thing we never had any kids either. I actually held on to the ring for a few months in case he came back for it but when he did it was too late I had already sold it.
