I need everyone's input on a little "ebay crisis"

Ok guys, here in a nutshell is what happened , I just need your input on what I should do:

I bought a 33oz bottle of Back to Basics shampoo from Ebay. When the package arrived there was shampoo all over the place, and the post office even had to put it in a plastic bag. Our mailman told me to just "return it to the sender , b/c the person who sent it did a really crummy job packaging it". So I returned it to sender, and contacted the seller.
She pretty much said I was S.O.L, and it's too bad I can't get my money back b/c I chose not to insure it. The money was only $20.50 but that's a lot for getting nothing. She was totally not helpful at all, her tone was "well too bad for you, I already got your money".
I'm really feeling that this whole mess is so unfair, and I feel like I'm getting the short end of the stick here. But,on the other hand, yes I should have insured it, but I would think if you were packaging something that would spill like shampoo, you'd make sure it was totally secure.
What should I do, I really try to never give negative feedback, until every avenue has been exhausted. Do you guys have any suggestions on how to resolve this??
 
It sounds like you trusted the seller and she didn't live up to it, but legally, I don't think there's anything at all that you can do. It's just one of those "oh well, tough luck" kind of things that happen to us all. Sorry it happened though.
 
does ebay have a customer service dept. at all? it seems most companies lately will do what it takes to make things right as long as you ask the right person. i think the person you talked to was not the right person and you should try again. if not, there's nothing worse than bad press so if it doesn't get resolved to your satisfaction then tell everyone that you know.

You email the mediator with your comments about the transaction and he/she contacts the Seller. I almost used this service once when I ordered a CD but changed my mind because the dollar amount was less than $10. But boy was I steamed. The guy charged $4.50 for S&H ($1.00 more than he listed in the item description) and he mailed it in a .40 cent envelope with no packaging and the postage was only .57 cents. The CD was in a cheap case with no original inserts and was so scratched it looked like a rabid cat attacked it. And dirt actually fell on my lap when I opened it. Grrrrrr. The Seller ignored my emails so I ended up just mailing the CD back to him with a letter telling him that if he was so hard up for cash he had to sell such a pathetic item then he must need the money alot more than me.

I've used ebay quite a bit and only had that one negative experience but there's always that chance with that sort of market. Try the mediator service and if you're still not happy leave negative feedback, after all, that's what it's there for.

I really truly appreciate hearing from everyone!
I guess it is one of those "tough luck" situations, but I did contact the seller again. Even though it's not how I would resolve the situation, it's better than nothing.
She and I reached a compromise in that she would just transfer the remaining shampoo in a different (hopefully sturdier) bottle, and send it to me. Trust me guys, I've learned my lesson. I suggest either get your ebay items insured or make sure you talk to the seller about how your item should be packaged.
Again, thanks to everyone, can't wait for those new Cathe tapes!!
