Anna Nicole Smith Is Dead, Her Lawyer Says

Reality star Anna Nicole Smith is dead, her lawyer told FOX News Thursday.

Smith, 39, did not respond to CPR, and her boyfriend, Howard K. Stern, was with her when she passed, her attorney, Ron Rale, told FOX News.

Smith was found unresponsive Thursday in her Hard Rock Hotel room in Hollywood, Fla.

Emergency responders performed CPR at the scene and a breathing apparatus was inserted in her throat, hotel officials told TMZ.com. Smith was immediately transported to Memorial Regional Hospital in Hollywood just after 2 p.m. EST.

Local streets were closed off to rush Smith to the hospital, three miles away. Paramedics were seen pumping her chest as she was taken from the hotel.

Smith was hospitalized for a week last November with pneumonia. She was photographed at a boxing match at the Hard Rock Hotel last month.

In a lawsuit filed last Thursday in Los Angeles Superior Court, Smith and TrimSpa Inc. were sued in a class-action lawsuit alleging their marketing of a weight-loss pill is false or misleading.

Smith, a former Playboy Playmate, endorsed TrimSpa and was a spokeswoman.

Smith's 20-year-old son Daniel Smith died in his mother's hospital room in the Bahamas in September, three days after she gave birth to a baby girl, later named Dannielynn Hope Marshall Stern.

Smith's current boyfriend and longtime lawyer Howard K. Stern, 38, says he is the father of Dannielynn. But Smith's ex-boyfriend Larry Birkhead, 32, claims he's the father, and has sued to demand a paternity test.

Last month, a judge in the baby dispute temporarily blocked an order forcing her daughter to undergo paternity testing.

Rale questioned the legality of the test, saying Bahamian authorities needed to grant work permits before an American doctor could conduct the test.

The judge granted a stay pending a hearing which was supposed to take place this week.

Birkhead's attorney, Debra Opri, called Rale's request "a delay tactic." Birkhead sued in October to get a paternity test.

Anna Nicole Smith was born Vickie Lynn Hogan in Houston, Texas, on Nov. 27, 1968.

As a teenager, she worked at a fried chicken restaurant, and married Billy Smith at age 17 in 1985. The same year she had son Daniel Smith, but then divorced Billy and became a single mother in 1987.

Smith worked a string of minimum wage jobs before turning to stripping. She met oil mogul J. Howard Marshall II in 1991 in Houston at a nightclub, where he was a frequent patron and she worked as an exotic dancer.

Smith married Marshall, 63 years older than she, on June 27, 1994. She was 26, he was 89.
 
OH my goodness. First her son and now her. I wonder what happened and what is going to happen with the baby girl since that paternity suit is going on. How sad.
 
Why are people so shocked by this? She was a mess--I don't remember seeing her that she wasn't under the influence of something! The saddest part is a baby girl with no brother and no mom.
 
You might know how I feel about celebrities.....despite that I always thought that Nicole, despite being a mindless twit, was kinda cute in her own little way and I genuinely felt sorry for her after the death of her son. I'm sorry she and her son are gone and I am sorry for her little girl.
 
So sad to hear that and my heart goes out to that baby girl. Some things come to my mind though a: she OD'd intentionally (grief from the death of her son or b: maybe her lawyer/husband had something to do with it since he was present at both her & her son's death.!? Hmmm.....
 
I know what you mean about celebrities. On very few occasions, I make an exception...this is one. I don't believe she was a mean person and I think she suffered so much tragedy in such a short life. I pray that her baby girl can have a good, safe childhood and may her mother rest in peace.
 
Funny that you said that. I remember something about Anna Nicole's mother saying that she was worried that the lawyer/boyfriend had something to do with her grandson's death. She said she was worried Anna was going to be next. I thought she was strange, but now I wonder a little bit.

I feel so sorry for her little girl.
 
Very, very sad. I was shocked to read this. My heart goes out to her new daughter.

I wasn't surprised. I was driving in to work and they were talking about her on the radio and I just thought to myself "Poor thing, I bet she is going to die soon".

She has really had a mess of a life. :-(
 
Shocking! Absolutely shocking. I also saw that interview when her mother said that she felt Howard K. Stern had something to do with her grandson's death and she also said she was worried that Anna was going to be next. Like I said I'm shocked.
 
It's all very strange, I do know I saw an interview with Anna and her husband, and she appeared very drugged up. I hate to jump to conclusions because it could have been anti-anxiety meds etc..but she certainly looks like she's on methadone or something numbing. I will pray for her family though.

I can't help but think, "the high price of fame." So many famous people just can't seem to deal with what they wanted in the first place, being famous. Someone on the radio said she wanted to be like Marilyn Monroe.... so there you have it. Very sad.
 
Does anyone wonder if this had anything to do with her very rapid weight loss in the last couple of years? On CNN they talked about how ephedra was legal during that timeframe. Since she had a baby recently, one wonders if she felt compelled to lose the weight too quickly... interesting.

I feel sorry for her child. Hopefully paternity will be established and she'll end up with one sane and stable parent.

Yes, she is the real victim here and so is Anna's son. Hard life or not, I can't say I am shocked, surprised, or sad that she is dead. I could see it coming.

I also saw the interview Amber is talking about and I thought the exact same thing. She was a mess. It was hard to understand what she was saying and she seemed to be pretty out of it. I was shocked when I read the article, but the more I thought about that interview the less surprised I was. It's a sad situation especially for that innocent little girl.
