Wendy, I'm so sorry! That is horrible and probably happens all of the time. What an absolute jerk, and can you imagine sending your kids out to the street to clean up the mess you made because you are too drunk and scared to do it yourself! How messed up are they going to be??!!

Let us know what happens. And just an FYI, depending on who you are insured with, even if you have to go through your insurance, the insurance company should take steps to recover their l0ss through HIS insurance; you may not have to sue at all. Definitely talk to your agent and see what they have to say about that.

I'm so sorry this happened! I hope that the guy admits that he did it soon, so you won't have to go to court and deal with that hassle. If he took his truck to a garage, do mechanics have to report obvious wrecks? I've always wondered about that, especially thinking about cases of hit and run.

Wendy--Marie's post jogged my memory. My husband was sort of rear-ended (while actually, the guy, who had dropped his cig was going about 55 mph in a 35 mile zone, looked up just in time to avoid slamming into my husband, who was waiting to make a left hand turn and swiped the side of the car instead, smashing it all up.--Our 18 month old would have been killed, had he not looked up in time) but anyway, we had a witness and we got the offenders information. Our insurance company covered our losses and then went after the guy for us. I have no idea whether they got their money or not, but we did.

Maybe your insurance has a similar policy.

I FEEL YOUR PAIN AND DISGUST!! You just described my experience about 3 years ago New Years Eve almost exactly. We were at a friends house until about 3am. When we got home my husband looked out the garage door window to make sure he shut the door and said the same you did. The whole passenger side was smashed in. Our car is black and we didn't even notice it since it was night and the car door still opened. We called our friend's and they said they were going to do some checking and the IDIOT across the street backed right into our car and then left. You could still see the glass from his tail light. We called the cops and filed a claim. Man was I mad. What a way to start a new year huh? Luckily the guy's insurance paid for it all. Both doors had to be replaced and repainted. I think it came to about $5500.00. I finally got my car back and was satisfied with it around March or April. Had a piece of crap rental for a month. Then they did a crappy job on the repaint and I had to keep taking it back for things like them forgeting to hook up the auto door lock and windows.

Well, to our surprise the offending vehicle has re-appeared and the dope didn't even fix it! HA HA HA HA!!!! DH got the liscense plate #, took pics of the damage on his truck (as well as ours actually) and called the cops. Hopefully we will not have any problems getting our damage paid for now! :)

I called our insurance company and they are noting that I mentioned the accident to them but I was advised not to call the claims department (if I even need to at all) until after the cops are finished with thier investigation....

Will let you know when the guy is actually confronted by the cops...he hasn't been yet, as far as we know anyway...

Gotta go work out now...been putting BODY MAX off all day long!:eek: }( :p

Wow, I had the same exact thing happen to me the end of March. I go to bed with my car intact and the next morning, while trying to load my bags in the car to go to the airport, I couldn't open the passenger side door. The whole front corner was damaged ($2,000 worth!). Luckily, I was still able to drive to the airport. I called the cops when I got back from vacation.

Since I had no proof of who did it , the cop did some investigating and "threatened" the neighbor across the street. They didn't come forward on their own, of course; it took the cop to approach them before they admitted responsibility! He said they had no insurance/no money and I wouldn't get any money if I went to court. They have $200 yet to pay from my $500 deductible. Neighbors!!

Oh Wendy, I'm so sorry! Thank goodness no one was injured. I hope the guy pays and that your family and you will not have to endure a long, drawn-out court battle over this.
 
Aside from being an a-hole and an idiot, your neighbor is guilty of both hit and run, and trying to cover up a crime (the hit and run). He should not only pay for damages to your car, but be charged on both counts. Maybe even pay punitive damages.

(I'm no lawyer, but I watch them on T.V.!)

I'm surprised the police isn't moving faster on this, because the more time passes after a crime, the greater chance that evidence will disappear or be destroyed.
 
Guess who is still sitting here with her thumb up her a$$ waiting for the damn police to respond to her and DH about the accident!?!
The cop was supposed to be back that wednesday and never showed...meanwhile the guilty vehicle has been sitting on our street since the monday afternoon after it happened! Dh has called the police dept several times. No one else wants to help him. They keep saying to leave a msg for the guy who came out originally yet we never hear back from him! Aside from going there in person which DH will be doing on wednesday, I am going to write a letter to everyone and anyone I can think of about this. It's horrendous!!!!
 
Have you taken pictures of the guilty vehicle? It may betray some of the damage that it did to your car. My husbands work truck was hit by some sort of construction vehicle at work and he and the head contractor took pictures because some of the white paint had scraped off on to it. It was helpful in getting a positive result. (The guy, when presented with the evidence, offered to pay, so there was no court case).

My grammar is atrocious. I'm sorry--I hope you can figure out what I am talking about.

Anyway--sounds extremely frusterating.

We have several pics of the guilty vehicle as well as our damage and we have his lisc. plate # which we GAVE to the police dept as soon as we got it! DH wants to avoid confronting this guy himself b/c depending on how he reacts there COULD be a fight. I have emailed my good friend. She works for an attorney. This kind of stuff is not his forte' but I'm hoping he can tell us what our options are. I am also calling my insurance company tmrw to explain it to them. I called them once to let them know what's going on w/o actually filing a claim and they said they will note it. I'm calling again tmrw...who knows...they may have some advice on what to do or maybe THEY can do something??? I don't know but SOMETHING has to happen and SOON!!!!x( x( x( x( x( x( x( x( x( x( x( x( x( x(

Holy cow!!!!

DH just called! He finally got in touch with the cop! My neighbor ended up going into the police station last Sunday and confessed to what he did! :7 :7 :7 This actually WILL get rectified!!! YIPPEEE! I have NO IDEA why the cop didn't call us and let us know but this is what he told DH. I am sooo happy! The guy was issued a summons for hit and run and has to appear in court...I may have to go to. I'm not happy about THAT but I'll deal. I'm not the one who's in trouble.

The sad part is that the guy STILL could have come knocked on our door and he would have never gotten the summons if he would have just 'fessed up to us and given us his insurance info.

The cop took a walk down to the guy's house the day we called it in and was going to talk to his wife to see what she knew about it (the guy wasn't home). He knocked on the door but had to take off on a call before she answered. The cop & DH think that the wife saw that it was a cop and told her husband and he got scared cause he figured he was caught so he went and confessed the next day.

Oh what a relief. I feel like a 1000 pound boulder was just lifted off my shoulders! PHEW! :)
 
glad things are going to work out. i hope your neighbor there will learn his lesson from all this and get himself some help before he kills somebody the next time. luckly nobody was in the that car and you are okay but what a pain to deal with all this. good luck!!

Hey Kassia...do you know what the ironic part of all of this is?? This guy has been invited to parties that our other neighbor has had and would NEVER accept a single alcoholic beverage from them!!! We think maybe he's a recovering alcoholic who had a relapse...if not, then I have no clue! Maybe he wasn't drunk...maybe it was drugs???
 
wow, sometimes those that have a problem are embarressed in front of others. i never drank in front of my neighbors and parents but they knew.
