How Many Bad Checks....

Can one person write?

The reason I am asking is because bil and his wife cannot stick to a budget whatsoever!! Bil rides to work with dh and they are supposed to split the gas bill. Here lately, bil hasn't had his end of the bill and dh has to cover for him. That cuts into our budget, which makes me soooooo angry!!! I am very strict with my budget and I don't like it messed with because bil and his wife are irresponsible. They are constantly -$500 or more in the bank, but they keep on writing those checks. Sil's name is on the don't take checks from these people list" at the local gas station. They think the bank is going to cover every bad check because they charge them a fee. Can't they go to jail for this??? I am starting to think that is the only way they will get their act together.

They way they will get it together is to stop covering for them.
It's putting a strain on you and DH financially. So that means that BIL doesn't get a ride to work until he can afford to pay for it.

He's going to get there one way or another, so he can either deal with public transportation, or stick someone else every month.
But putting a dent in your pocketbook, particularly with the cost of gas these days?

I'm very black and white when it comes to these things, so I'm sorry if this sounds a little hard core. But I've had too many people take advantage of my good nature in this same way that I had to learn to put a stop to it.

Take care of yourselves 1st, others 2nd. People will leech off of you as much as you let them.

Just venting my own opinion, so hopefully this didn't offend you.
 
I agree. Bil is no friend and dh should tell him ..no more car pooling unless he pays up with cash...

I am black and white with this crap too. You shouldn't be taken advantage of.
 
Whether or not your BIL pays his fair share of the gas or isn't allowed to ride, DH is going to make the trip anyway so the gas $ should be in your budget.

I'm not saying bail BIL out but you're going to eat that gas money one way or the other.

Working in the finance world, yes, your bil and sil's behaviour could land them in jail or how ever your county chooses to deal with this kind of crime. Post dating and/or writing a check and knowing the funds are not in your account to cover it is illegal. If the negotiable instrument can be covered by Lines of credit or savings transfers, then it is considered to be all good.
 
....unless Bil is getting picked up exactly along the route or is being picked up and dropped off at dh's abode.... there is some extra driving involved for driving Bil (and some extra fuel used for the extra weight in the car even if Bil is less than 125 lbs) which equals extra money. In any event, even if gas usage was the same, kick the bum out...a commuter train would kick him off if he couldn't pay even though it wasn't adding extra miles to the trip for transporting this passenger.
 
well if they knowingly write checks with a negative in the account yes they can get in legal hot water to say the least. and melimcn makes one hell of a point b/c i have been there. my goodness if i was paid back every single cent ppl mooched off me back in the day i would not have a worry in my world now.

you are just going to have to say to him whatever money problems he has is THEIR business and they have to work that out but until then you have your own problems and he is adding to them. we all have our problems with money,its the whole world, its how we choose to live and handle the situation that helps us get by.

I work in the finance industry and the answer is - people will write as many bad checks as you let them!! We have a 1 strike and your out policy. It's cash/money order/wire transfer for the rest of the loan. People try to play the "beat the check to the bank" game. It doesn't work. What they don't realize is part of the reason they are so in the hole is because the bank is taking the fee out of the account to cover the check. It adds up pretty quickly. I'm not sure it holds true for all states, but it can be a felony to knowingly, and consistantly write bad checks. It's fraud.

If they ever use a bad check to make a down payment on a contract item (car, house, whatever) and that check bounces, that contract is now void, because it is not "true" anymore. The down payment has never been paid. I would think their bank would eventually have enough and will close the account. The best way to help them, is to not help them. For some people the only way to learn is to fall on their butt.

Interestingly enough, when we get a check back and I call the customer, they always claim one of two things. 1 - the money was there and it was the bank's fault. 2 - they don't know what happened to their money or where they spent it. Also, a lot of people don't understand the concept of outstanding checks. Just because the bank says the money is there, doesn't mean it is. If you just wrote a check for $100 and it hasn't cleared the bank, you CAN'T spend the $100 elsewhere because you DON'T have it. I will stop now.

Thanks for the replies!!! I would have replied sooner, but I have been down with the flu/sore throat.

I am a firm believer in tough love. My dh, however, is a softy and lets people walk on him. He actually has another guy who rides with him and he always has his fair share of the gas bill...which is only around $20 a week or $80 a month. Apparently, bil has not had gas money for a couple of months now and the other rider was covering him. Now, Dh is covering him. Bil is also behind on their car payment and other bills. However, they always have cigarettes, new dvd's, alcohol, expensive grocery/necessity items.

Bil is getting his tax return this week so he will be paying dh back this week. But, the $4000 will be gone in a week and he will have nothing to show for it!!! So frustating!!!
