Going to court-long

My DH and I are going to court next Monday. Here's the story. (I'll try to be brief.)
My 21 year old son has Prader Willi Syndrome. When Tristan was evaluated, the neuropsycologist told us you couldn't average the scores from the different parts of the brain to get an IQ, because they are so different, the average doesn't reflect what is going on. Tristan scored high in the ability to learn facts, but very low in the ability to take outside stimuli and information, process it and react to it appropriatly. The doctor said Tristan's brain is like a wild horse without a rider, or a football team without a coach. When these scores are averaged, his IQ appears to be about 80. The county we live in won't provide mental retardation services to anyone whose IQ is over 70. The definition the state uses for retardation essentially says the same thing the doctor said - you can't use the test scores alone. You also have to consider the divergence of the scores and certain life skills. When all is considered, Tristan is considered "clinically mentally retarded."
We had to appeal the county's decision to the state department of welfare. They ruled in Tristan's favor and ordered the county to provide services. The county filed for a reconsideration of the ruling, which we also won. Now they are appealing to the Commonwealth Court, which is where we are going next Monday.
Meanwhile the county put Tristan on a "waiting list" for $$ to get into a residence specific for his syndrome and needs.
So, long story short, I would like you to pray, think, whatever your belief system calls for, for Tristan and our court date.

Oh Robin, I just can't get over it!! It amazes me how people don't want to use funds to help someone in obvious need but somehow they have plenty of money to fight you in court. Unbelieveable!!! I'll keep you and your situation in my prayers and do please keep us informed.

I'm sorry to hear that the county is giving you so much trouble, and I think it's a shame. It sounds like you're going to keep on winning though, and I wish you lots of luck. Give Tristan a hug!
 
That really is a shame. And I don't even want to think about the BS your county has pi$$ed money away on, when it could go to people who really need it.

Good luck--I really hope they do the right thing.
 
All my best thoughts, prayers and wishes for you. I'm currently battling government bureauracy on behalf of an elderly relative. I know first hand how frustrating this can be. Hang in there.

Will be praying for you. Sometimes these people act like the money is coming out of their own pocket. My son Isaac was diagnosed w/ autism, they told me it was like standing in the middle of the street and the cars are going by at 100 mph. I applied for SSI for him and my husband makes too much. He can apply when he turns 18 and they have to give him benefits, they are not allowed to go by my husbands income then. At least that is what my DDD worker told me.
 
Why does it seem like the people who truly need help the most have such a hard time getting it? I can't even imagine how frustrating this must be for your family. Best of luck in court.

Thanks all. I will keep you posted. It has been a long, frustrating 3 years and I doubt this will be the end. If they lose, they can appeal to the State Supreme Court, and if we lose, you can bet we'll do the same. In the mean time, my DS spends his day sleeping,stealing food and having terrible temper tantrums.

Heather, we got SSI with no trouble when DS turned 18. We thought that would be harder than anything.

LauraMax- you're right about the $$. I know it's cost us a bundle for a lawyer, so I know the county is pouring $$ in their lawyers pockets.
 
good luck robin i hope things go well "commonwealth court" are you in virginia by chance. they are sure at taking their time about getting services whether they say we "qualify" for them or not. i hope it goes well. i really hate the red tape government puts up for disabled kids.
