When you have a leased car instead of a regular loan thru a bank is there a rule that only that person who leases the car can drive it?

Hi Kim...my DH will know the answer to that...he is due home in a bit and then, we are leaving to take our son out for his birthday. If no one replies to this, I will answer for you later tonight.

Who can drives it is determined by your insurance. If your insurance states that you are the only one insured, then only you can drive it. But, if your insurance states that others can drive it with your permission, then that applies. There are diff types of leases...there are leases that actually title the car in your name. There are also leases that leave the title in the name of the insurance company. There are diff laws for diff states governing insurance companies. Your best bet is to read the back of your lease agreement under "driver's & insurance obligations" & also contact your insurance company to determine their rulings. Good Luck! (Hope this isn't too confusing. I'm typing slower then DH is talking!!!!)

It's not actually our car that is the leased car. My SIL (my husband's sister) just got married and moved to Australia for the next 2 years and could not get out of her lease with Nissan without paying a good chunk of change for it. She left the car at her parents house and said that if anyone ever needed a car to drive feel free to use hers since it will need to be driven until she gets back. My husband is having truck trouble and asked his dad to borrow Cindy's car and he said no because he didn't think the insurance was paid up on it and his mom (who just flies off the handle at everything) said that only Cindy could drive it since it was a leased car. We emailed her yesterday asking her if it was OK with her and she said that it was fine. So I'm not sure if she's aware of any kind of special driver limitations or not.

The fact that the car is leased doesn't have any bearing on who can drive the vehicle. Insurance covers the vehicle regardless of the driver. If the primary driver of a vehicle changes, it is the owner's responsibility to inform the insurer as this has an impact on how your rates are determined. However, if you are borrowing someone else's vehicle and they have little to no insurance, your own coverage may come in to play.

Anyone can drive your car with permission. A rental vehicle is another matter, but if the car is leased, anyone can drive it
