Pizza Shop Must Pay for Employee Weight Loss Surgery

horse puckey!!! That's just crazy...sorry but did the pizza place deliver and feed him pizza after his accident. I can see paying for the surgery to help with his chronic pain directly related to the injury...but the accident didn't cause him to gain weight...choices did. Sorry if that sounds harsh but people need to take some personal responsibility!!! He could try to lose weight the old fashioned way...just because he has a back injury doesn't eliminate that as a possibility. If he can move some extremities he could participate in some type of exercise-upper body ergometer, recumbent bike, water walking, water aerobics...and he can watch what he eats. If he CHOSES to go the surgery route then HE should pay for it!!!

Not only should the insurance company cover the cost of his surgery they should be required to provide him with a lifetime supply of Fruit Loops because as we all know, they are health food now.

This all makes me think of that classic flick....Idiocracy. We're almost there kids!

Oh, that is crazy!! And the reality is that because of lawsuits such as this, companies like that will hesitate before hirer someone overweight again. After all, all they have to do is run into a door handle and claim severe back pain and they, too, can have free weight loss surgery! Oy vey...

The scariest line is that other juries have come to that conclusion as well...
 
This is absolutely ridiculous! I agree with the post saying his own choices made him obese, not the company. Why should the company pay for his gastric bypass?! I am so sick of all this sue-happy hoopla that goes on in this country. It is really sad and discouraging. It seems like no one takes responsibility for their own actions.

Could it be possible that he had a bad back because of his weight before he got hit with the freezer door, and the smash just exaggerated it? I'm playing devil's advocate here but I find it hard to believe someone needs emergency surgery from getting hit with a freezer door. At 340+ pounds, you're bound to have SOME sort of back problems to begin with!

My concern is one brought up in the article. Will the outcome of this lawsuit, and the publicity it receives, have a negative effect on a company's willingness to hire someone who is considered obese. Heck, the CEO of The Cleveland Clinic said if it was legal, he wouldn't hire anyone considered obese. That is a great attitude for someone in healthcare!

And don't forget he's a smoker, too. They'll have to pay for something related to that next! This is pathetic. The guy was huge when they hired him. They didn't force feed him. I'm with the company on this one - just don't hire him in the first place. When are people going to begin taking responsibility for their own actions.
 
Have mercy! This had GOT to be a joke! Personal responsibility seems to be completely unheard of anymore...geesh!
 
This just came to me in my Safety Advisor email the other day in conjunction with another weight loss prior to work comp injury treatment for a knee replacement which would be useless without weight loss. Mind you that employee gained 100 lbs while working for the employer.

Ludicrous at a minimum !
 
this is exactly the stuff that is ruining healthcare, cost of insurance, and business practices in general. no i worked at burger king, restaurants, and currently work at a school. i am around food ALL THE TIME!!! pizza,fries, tacos etc etc. they are not all healthy but they are tasty. but i DON'T EAT THEM. i have a mind of my own, i think before i sit down and have lunch. i always make a salad but everyday i might change up what i put on it. some days just turkey other days maybe some chicken fajita filling. the point is i make my choices good or bad and i live with ME,MYSELF, AND I live with it.

this is not good for this business and others have said this will put employers on the edge about who to hire b/c of stupid lawsuits like this. the jury and judge should be slapped upside the head too. this lawsuits are ridiculous, not saying the person didn't need help but why should a hard working business owner be drug through the mud and muck and then forced to pay b/c of a person who didn't think for themselves.

gogigi you hit the nail on the head-these types of lawsuits are what leads to some of this too. gotten completely soft as a country and in the legal system. if i were a judge i would tell this man to stop wasting my time with this and grow up and learn responsibility. nobody put a gun to his head to live an unhealthy lifestyle. nobody taught me to change my ways i did it on my own without little help(until i got a computer and came here for advice).

sorry to be so ranty raving but this is ridiculous, this is why things are falling apart. young kids in trouble b/c a parent won't take the responsibility of being a parent,unhealthy ppl expect drugs and drs to fix their problems for them as well as other things that ppl refuse to do for themselves. and if it doesn't work in their favor they threaten lawsuits instead of saying oh well live and learn and i have to fix it
