Need some advice

OK ladies, how would you handle this one?

I ordered some DVDs from this very website, the total of which was $95. A lot of money for me. I tracked the package and saw it had been delivered and signed for by the management office. Unfortunately when I got home--no package. Now, I live in a building with about 100 units and everything is delivered to the management office, then delivered by them to just inside your apartment door (they have the key and I signed a form allowing them to do this.) I checked in the office the next day--their records show that it was delivered to my apartment. I figure they must have delivered it to the wrong unit, so I had them ask around at other apartments and check in the vacant apartments. Eventually (after about two weeks of foot-dragging) they posted a sign in the lobby asking folks to be on the lookout for the lost package, but it hasn't turned up. So, now it's been 3 weeks, and I don't think that whoever got my package intends on being honest about it and returning it. I asked the management office what they intend to do about the situation, and their response was very coy--"send us the invoice, but we can't promise anything."

So what is fair in this situation? I don't think it's fair that I eat the cost. Should I insist they replace the package? How much time should I give them? I withheld the money from my most recent rent check, but now I'm regretting that a bit, maybe I'm being too aggressive and not letting them sort this out on their schedule. Ladies? What do you think?

I really don't know the law, (I bet someone here does!) but I would feel the person who signed for the package would ultimately be liable for it...Carole
 
I would think that the person who signed for it would be liable too! I would talk to your mgmt. office again and see if you can come to some type of agreement.

Good Luck. I feel for you. That is alot of money to have spent and don't have anything to show for it!x(

Maybe also contact UPS customer service and see if they have any advice for you. I am sure this won't be the first time they have dealt with this situation.

Sorry to hear about your situation. I'd be really ticked too. I've had my fair share of delivery problems when I've lived in various apt. complexes.

If somebody signed for it, UPS should have a record of it. I know when I lived in an apartment, whenever I got something I had to sign for it and the UPS guy also asked what my name was after he saw my signature. So, if you figure out who signed for it, you should be able to figure out where the heck your package is.

IMO, UPS should be responsible for it because it sounds like they delivered it to the wrong person.

Ifi understand correctly...it was your management office that put it in the wrong apartment. Seems like that would be easy to do properly since the apartment number may have been on the package. Just a matter of looking down, isn't it? The party not capable of matching numbers from package to door is liable.

I do not think you were aggressive to withhold the $$$ lost from the package. I actually think that is a good idea. You have an agreement with them and they did not withhold their portion of the deal.

No, those are gone for good. I suppose I'll reorder them. I guess I'm afraid my building won't believe me that I never received them, since I have no proof. Could get ugly. Thanks for your advice and concern everyone!
