Atricle: Atkins Lawsuit

That is just absurd. At that man's age, you don't develop heart disease after two years on any particular diet. I wonder what his family history and eating habits for the other 51 years of his life were. Unbelievable.

I've been on Atkins for the same amount of time, had my cholestoral checked two weeks ago, & all levels are fine. You can do Atkins in a healthy way, it doesn't have to be a super-high cholestoral diet.
 
I have to agree with Maximus on this one.

They say your "life style" eventually catches up with you no matter how long yourve been "clean" - so I would be curious to find out his eating habits and activity level BEFORE Atkins, before someone jumps to conclusions.

This type of thing reminds me of:

Obease people trying to sue fast food outlets
Smokers suing tobacco companies after 1975
Jane Fonda devotees suing her over "SAID" back injuries due to us 'NOW" knowing some of those exercises WERE dangerous

However ... I am an RN who now makes a living going through the medical records in insurance claims to assist the reps with finding issues of causation, reasonableness of bills, etc. So ... I didn't read the article, but if the man can prove he had "clean" coronary arteries before he started the diet (and that would be in the form of diagnostic evidence like a heart cath), he could possibly win his case. He would have to show by medical records or the testimony of his cardiologist that he had no signs of heart disease beforehand. As I said, I didn't read the article so I don't know all the facts, but it is possible he could successfully sue. Just playing devil's advocate here and letting you know the possibilities. It's amazing to me at work everytime I hear about a jury verdict in one of our cases where it appeared pretty cut and dried to us from a medical standpoint, but a jury saw things quite differently.

Yes, some people do fine on Atkins. But not everyone eats the "right" kinds of fat while they're on the diet. I'm betting this is not the last lawsuit we'll see come out of this. It should be interesting to watch what happens with these.

P.S. I would appreciate not getting any flames or other nonsense from this post please. I'm just trying to point things out from another point of view. I don't have an opinion on this man's lawsuit one way or the other, so I'm really not going to "argue" with anyone on here about it. Thanks in advance.

Carol....nobody should be flamed over their opinion (but it does happen here) and we all have our opinions...:)...I started this thread not for any harsh feelings but because I thought it was interesting as yes...there are ALOT of frivilous lawsuits out there. I enjoyed reading the posts so far...:)..thank you for yours.

This guys point I believe is not for a huge amount of money ($15,000.00), but to warn people what happened to him. This will not happen to all who have gone on Atkins, but should make anyone think about discussing any diet with their Doctor before going forward....:)...Carole
 
Carole, I read the article. VERY interesting! Apparently he does have medical documentation he did not have heart disease before he started the diet. This should be a fascinating one to watch.

I know you didn't start the thread for any harsh feelings, so I'm sorry if you thought that's what I implied. I'm a little sensitive these days on here. It's been kind of over-charged here all week. Must be those Hardcore pics getting us all fired up!! LOL!!

No Carol....I didn't think you implied a thing...:)...I just wanted to share my reasons...I normally skip most of the over-charged posts myself...I did do a bit more research on this subject and I will be curious to see how it goes. I guess lawyers must not be busy enough. Somehow the line has to be drawn someplace as to where individual responsibility for our actions comes into play. If this "person" had done any research before starting the diet, they'd have known some of the issues associated with being on Atkins. Once again----if it sounds too good to be true, it most likely is too good to be true. To me, this is what people get when they blindly follow other people's leads without putting the work in to get all of the info.
This litigious society we live in is disgusting.....
Heart disease can occur at virtually any age by the way, based on many factors like genetics, diet, environment, etc.

Ah Trev yes ... but I read Dr. Atkins' book. He mentions fats and the research about them contributing to heart disease. He says not to worry about the cholesterol and other numbers (paraphrasing going on here! I no longer have the book so I'm trying to remember the tone of what he said!) because over time they will be lower than when you started. I believe he recommended having them drawn before you start, and six weeks into it. The overall tone is that you won't be harmed from eating large amounts of fat. I may be wrong here, but I distinctly do not remember him guarding against "bad" fats.

I was working in the Cardiac ICU when I tried this diet. I respected every single cardiologist on staff at this hospital, and when I asked them about this issue, they all told me to stop the diet, and stop it NOW. They explained to me in detail why it would harm someone in the long run. None of the explanations they gave me were mentioned in Dr. Atkins' book. If that's all people read, and they believe it, they won't know the proven research out there refutes it. More needs to be done, obviously, to see if there's a way to do the diet and eat the "good" fats, without hurrying heart disease, but we aren't quite there yet.

My point is that unless you know all this other stuff beforehand, you're apt to take his book at face value. Heck I did the diet for four months! And I'm a critical care nurse!! I got a nice big kidney stone they had to surgically remove from eating like that, and my urologist said ABSOLUTELY it was from the diet. It was a uric acid stone. Those are from by-producuts of TOO MUCH PROTEIN. Since I was already prone to stones, that is not the kind of "diet" I should be doing. Should I have sued? LOL!! Of course not.

I hear what you're saying about personal responsibility, but people believe things they read. Especially when the author has the title "MD" after his name!! LOL!! This will be an interesting case to watch, for sure!!

To everyone, I realize not everyone will have negative or adverse effects on Atkins, but please be careful if you decide to try this. There is still not enough solid research on the long term effects, so please keep a watchful eye.
